What happens if I die without a will?

If you die without a will (known as "intestate"), your estate will be distributed according to the Rules of Intestacy. This means your assets may not pass to the people you would have chosen. For example, unmarried partners have no automatic right to inherit, and children may receive their inheritance at 18 rather than a more mature age.

When should I update my will?

You should review your will after any major life change: marriage, divorce, having children, buying property, or if a beneficiary or executor dies. We recommend reviewing your will every 3-5 years regardless, to ensure it still reflects your wishes.

How long does probate take?

Obtaining a grant of probate typically takes 8-12 weeks. However, the full estate administration can take 6-12 months depending on complexity, the number of assets, and whether there are any disputes or inheritance tax matters to resolve.

Can I make a will if I have dementia?

It depends on the extent of the condition. To make a valid will, you must have "testamentary capacity" – meaning you understand what you're doing and its effects. We can arrange for a medical assessment if there are concerns, providing evidence that the will is valid.
